EMPLOYEE TERMS AND CONDITIONS

Your organization has applied to be considered for an Employee Recommended Workplace Award  (the “Award”), a workplace award offered by The Globe and Mail, Canada’s leading media organization, and Morneau Shepell, Canada’s leader in workplace health and productivity (collectively, the “Award Sponsors”).

The Award recognizes organizations for their efforts to provide a safe, healthy and positive work environment for their staff members and to give employees the tools they need to manage their work and personal lives. This Employee Survey is intended to help determine the overall health and wellbeing of you and your organization, and will ask a number of questions about the physical, mental, workplace and life components of your health.

By participating in this Employee Survey, eligible employees agree to accept and abide by these Employee Terms and Conditions and you are giving your consent to collect and use your data and information as described in these Employee Terms and Conditions.

Employee Survey Completion Period. The Employee Survey completion period begins at 12:01 a.m. Eastern Daylight Time (“EDT”) on March 20, 2018 and ends at 11:59 p.m. EDT on December 21, 2018 (the “Employee Survey Period”).

Eligibility. To be eligible (an “Eligible Employee”) to participate in the Employee Survey for the Award:

  1. Your Employer must have registered for an Employee Recommended Workplace Award by completing the Employer Questionnaire, available at https://www.employeerecommended.com, and be deemed eligible to participate in the Employee Recommended Workplace Award; and
  2. you must have directly received an email from the Award Sponsors to participate in the Employee Survey. Your Employer has authorized the Award Sponsors to directly send you emails regarding the Award.

How to Participate. You will receive an email from the Award Sponsors with a link to the Employee Survey.  Click on the link to review and agree to the Employee Survey Terms and Conditions and complete the Survey. In the Survey, you will be asked to answer questions related to four key pillars: work, life, mental and physical health. Each question must be answered in order for your Survey to be considered eligible. The Employee Survey must be completed online, using the online process. The Employee Survey can be completed in about 20 minutes and your participation is voluntary. At the end of the survey you will receive a personalized evaluation of your health and recommendations for improvement, a special subscription offer from The Globe and Mail, and the option of downloading an e-book on Micro Skills, as a thank you for your participation.

LIMIT: one (1) survey submission per Eligible Employee. Your submission in no way obligates the Award Sponsors to award any certification or award to your Employer. The Award Sponsors reserve the right to judge void any Employee Survey that the Award Sponsors, in their sole and absolute discretion, determine do not meet these Employee Terms and Conditions. You may not modify your responses.

Identity of Employee. Award Sponsors may disqualify any Employee Survey in the event of a dispute over the identity of the email account holder.

Proof of Receipt. The sole determinant of time for the purposes of receipt of a valid Employee Survey will be the computer servers of the Award Sponsors’ designated contractor. Proof of transmission (screenshots or captures, etc.) does not constitute proof of receipt. Only online Employee Surveys will be accepted.

Privacy and Confidentiality. By completing the Employee Survey, you hereby consent to the Award Sponsors collecting and using your personal information and to receiving commercial electronic messages from the Award Sponsors, for the purpose of administering this Award.  Your Employee Survey data will be aggregated into anonymous reports to: (a) assess the health of your workplace and compare with the results of surveys taken by employees in other organizations, (b) create a personalized health report for you, (c) provide your Employer with information about the overall health of your organization, or for independent research and analytical purposes. This analysis may also include information provided by your employer. We will make reasonable efforts to ensure that your data and any other information we receive about you will not be shared in any way that could reasonably identify you personally, and will be handled in accordance with our Privacy Policy, however any information transmitted over the internet is not without risk.

Licences, Warranties and Representations. All materials submitted become the property of the Award Sponsors and will not be returned to the Eligible Employees.  You hereby represent and warrant that the information you have provided in the Employee Survey is true, complete and correct to the best of your knowledge.  You further agree that the Award Sponsors may sublicense, publish, display, perform in public, broadcast and communicate to the public by telecommunication, the Employee Survey data, only in the aggregate and anonymized, and in accordance with our Privacy Policy. 

Conduct. By completing an Employee Survey, you acknowledge that you have read and understood these Employee Terms and Conditions and agree to abide and be bound by them and all decisions of the Award Sponsors, which shall be final and binding, without right of appeal, in all matters relating to this Award. The Award Sponsors reserve the right, in their sole and absolute discretion, to disqualify any Employee who it finds to be: (a) violating Employee Terms and Conditions; (b) tampering or attempting to tamper with the entry process or the operation of the Award; (c) acting in an unsportsmanlike or disruptive manner; or (d) attempting to undermine the legitimate operation of the Award. CAUTION:  ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS AWARD OR TO UNDERMINE THE LEGITIMATE OPERATION OF THIS AWARD MAY BE A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS.  SHOULD ANY SUCH ATTEMPT BE MADE, AWARD SPONSORS RESERVE THE RIGHT TO SEEK REMEDIES AND DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW, AND TO BAN OR DISQUALIFY AN ENTRANT FROM THIS AND FUTURE AWARDS.

Release of Liability.  By completing an Employee Survey, you are deemed to: (i) confirm compliance with these Employee Terms and Conditions; and (ii) release each Award Sponsor, its affiliates (including, without limitation, any parent, sister and subsidiary companies), suppliers of materials or services related to the Award and other parties in any way involved in the development or administration of this Award (including advertising and promotional agencies, public relations agencies), and all of their respective employees, directors, officers, shareholders, agents, partners, licensees, successors and assigns (collectively the "Releasees") from and against any and all manner of action, causes of action, suits, debts, covenants, contracts, claims, liabilities, demand or damages (including legal fees and expenses), of any nature or kind, arising out of, or in connection with your participation or attempted participation in the Award and the awarding or use of a prize, including as set out below in the Limitation of Liability section. 

Limitation of Liability. Releasees do not assume any responsibility and each entrant releases Releasees from any and all claims, actions, damages, loss, injury, costs, demands and liabilities of whatever nature or kind arising in connection with the Award including, without limitation, the administration of the Award the selection and confirmation of winners.  Without limiting the generality of the forgoing, Releasees are not responsible for: (i) the incorrect or inaccurate capture of entry information; (ii) late, lost, stolen, illegible, damaged, misdirected, mutilated, garbled or incomplete entries or entries that are altered or otherwise irregular, mechanically reproduced, submitted using robotic, automated, programmed, or through illicit means, included in a bulk-drop off, or contain false information, or do not conform with or satisfy any or all of the conditions of the Employee Terms and Conditions, as determined by each Award Sponsor, in its sole and absolute discretion; (iii) any failure of, errors, or problems with websites associated with the Award, including any website feature, howsoever caused, (iv) traffic congestion on the Internet and any postal delays, strikes or failures; (v) injury or damage to an entrant's or any other person's computer related to or resulting from participating in the Award; (vi) any website functionality lost due to not having cookies enabled; (vii) any errors, omissions, incorrect or inaccurate information in any Award-related materials howsoever caused; (viii) the security or privacy of information transmitted via computer networks or for breaches of privacy, including but not limited those due to interference by third party computer "hackers" or otherwise.

General

Award Sponsors, in their sole and absolute discretion, reserve the right to withdraw, modify or terminate the Award, amend the Award at any time, and reject any and all applications in accordance with the Award process, without individual notice, and for any reason. Award Sponsors will not incur any liability whatsoever by reason of such withdrawal, rejection, acceptance or modification.

All intellectual property, including but not limited to trade-marks, trade names, logos, designs, promotional materials, web pages, source codes, drawings, illustrations, slogans and representations are owned by each Award Sponsor and/or its affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.

This Award is void where prohibited by law and is subject to all applicable laws and regulations.  To the extent permitted by law, any dispute arising from this Award will be determined according to the laws of the Province of Ontario, without reference to its conflict of law principles, and the entrants consent to the personal jurisdiction of the courts located in Toronto, Ontario and agree that such courts have exclusive jurisdiction over all such disputes.
