EMPLOYER TERMS AND CONDITIONS
Your organization is applying to be considered for an Employee Recommended Workplace Award (the “Award”), a workplace award offered by The Globe and Mail, Canada’s leading media organization, and Morneau Shepell, Canada’s leader in workplace health and productivity (collectively, the “Award Sponsors”).
The Award recognizes organizations for their efforts to provide a safe, healthy and positive work environment for their staff members and to give employees the tools they need to manage their work and personal lives.
By applying for consideration for an Award, eligible employers automatically agree to accept and abide by these Employer Terms and Conditions. All decisions of the Award Sponsors with respect to any aspect of this Award, including without limitation the eligibility of entries, are final and binding on all entrants in all matters as they relate to this Award.
Award Enrolment Period. The Award enrolment period begins at 12:01 a.m. Eastern Daylight Time (“EDT”) on March 20, 2018 and ends at 11:59 p.m. EDT on December 21, 2018 (the “Award Period”) provided that registration (as described below) has been completed by November 22, 2018 at 11:59 p.m. EDT (“Registration Deadline”).
To be eligible to participate in the Award your organization must meet the following criteria at the time of registration:
- Be a company, business, or organization with a Canadian division in Canada OR with operations in Canada AND
- have more than 25 full-time employees in Canada (an “Eligible Business”).
If your organization is eligible to participate, then it is an “Eligible Business”. For greater certainty, an organization is not eligible if it is an Award Sponsor, or its affiliates (including parent, sister and subsidiary companies) or any other or other party in any way involved in the development or administration of this Award, including advertising and promotional agencies, public relations agencies, suppliers of materials or services or prizes related to the Award, or a member of the immediate family (spouse, parents, siblings and children, regardless of where they reside) or household member of any such party.
Registration must be completed by the owner or Human Resources director or manager or other authorized representative of an Eligible Business.
How to Enter
To apply for an Award, please visit the Award website at https://www.employeerecommended.com (the “Award Entry Website”) during the Award Period and do the following:
Registration Account. Before beginning the application process, you will be asked to create a registration account. You must register before the Registration Deadline. You consent to the collection and use of your personal information by the Award Sponsors for the purpose of creating your registration account. You must provide correct, current and complete information during the registration process. User information must be kept up to date. You may not pretend to be someone else or spoof their identity. You will create a login and password to your account, which is unique to your account and must be kept confidential at all times. You agree that you are responsible for all activities and transactions that occur through your account. You will promptly notify the Award Sponsors if you become aware of any unauthorized access or use of your account.
- Registration Fee. Eligible Businesses are required to pay a Registration Fee. Please visit https://www.employeerecommended.com for details on what fees are payable by your Eligible Business.
- Employer Questionnaire. You will be able to read the Employer Questionnaire Questions at this link prior to beginning the online Employer Questionnaire Submission. The questions are listed exactly as they will appear on the application form, so they can be used for preparation purposes. In the Employer Questionnaire, your organization will be asked to outline details related to the four key pillars: work, life, mental and physical health. Please answer each of the categories in the application. Each question must be answered in order for the Submission to be considered eligible. The Employer Questionnaire must be completed online, using the online application process and completed by the end of the Award Period.
- Employee Survey. After registration, your employees will be required to complete an employee survey (as further described below) for submission and your organization must meet the minimum survey thresholds (described under Survey Methodology). All employee surveys must be received on or before the end of the Award Period.
Your Submission consists of your registration information, the Employer Questionnaire and the responses to the Employee Survey.
LIMIT: one (1) Submission per Eligible Business. All eligible Submissions received within the entire Award Period will be eligible for
- a chance to be recognized as an Employee Recommended Workplace
- a chance to be ranked one of up to the top 25 Employee Recommended Workplace in your company size category: small, medium and large
- a chance to be recognized as an award winner in one of the categories based on the company’s size and type of company (as described below under the “Award” below).
Your Submission in no way obligates the Award Sponsors to award any certification or award to you. Odds of winning the Awards depend on the number and quality of eligible Submissions received. The Award Sponsors reserve the right to judge void any entry that the Award Sponsors, in their sole and absolute discretion, determine do not meet these Employer Terms and Conditions. Once submitted, you may not modify your Submissions.
Participation of Employees in Employee Survey. Your employees are the key to winning an Award – see Survey Methodology for survey participation threshold requirements. You are responsible for determining who amongst your employees are eligible to participate in the Employee Survey. We encourage you to have as many employees as possible take the Employee Survey to represent a broad cross-section of your workforce. Contest Sponsors expect that the Employee Survey will be sent to all employees in Canada and Contest Sponsors reserve the right in its sole discretion to disqualify your entry in the event this criteria is not met. Your employees will be asked to complete an Employee Survey in order to determine, in their eyes, your organization’s commitment to the four key pillars of: work, life, mental and physical health. In order to facilitate your employees completing the Employee Survey, you will provide the Award Sponsors with your eligible employees business email addresses.
You hereby authorize the Award Sponsors to send emails regarding the Employee Survey directly to your employees, and you represent and warrant that you have the authority to do so for your Eligible Business, in accordance with Canada’s Anti-Spam legislation (CASL), and agree to indemnify the Award Sponsors in respect of any alleged violations of CASL or applicable privacy laws.
You agree that the Eligible Business is responsible for all acts of your employees, including any acts in violation of the Employee Terms and Conditions to the Employee Survey.
Employee surveys will be scored using a proprietary methodology and algorithm by Morneau Shepell Inc. The Employer Questionnaire must be filled out fully for your entry to be valid, and the number of employees of your company that take the survey must meet the following threshold based on your total number of Canadian employees.

Submissions will be scored using a proprietary methodology and algorithm by Morneau Shepell Inc. There is no judging process. A score will be generated for each Eligible Business that registers and obtains the minimum number of Employee Survey responses. The score will be the final determinant for the winners. - Employee Recommended Workplaces: Eligible Businesses will be given the distinction of being an Employee Recommended Workplace and eligible to use the Employee Recommended Workplace badge. Organizations that qualify will be notified by Feb. 1, 2019.
- Top Category Winners: In addition, there will be a maximum of 12 category awards given out to top 3 Employee Recommended Workplaces based on the size and type of your organization at the time of registration:
- Three national winners for publicly owned businesses, Small, Medium and Large
- Three national winners for privately owned companies, Small, Medium and Large
- Three national winners for non-profit companies Small, Medium and Large
- Three national winners for governmental organizations, Small, Medium and Large.

The category winners will be announced in Spring 2019.
Confirmation of Employee Recommended Workplaces and Category Winners. The Award Sponsors will determine which companies receive the distinction of being named an Employee Recommended Workplace from among the Eligible Businesses based on Morneau Shepell’s methodology. Category Winners for all the awards will be announced no later than March 31, 2019. Award winners may be chosen to be profiled once the award winners have been selected in an editorial feature in the Report on Business section of The Globe and Mail print newspaper and globeandmail.com website, as determined in the sole discretion of the Contest Sponsors.
After the Award Program has closed and the Award winners have been selected, the Award Sponsors, acting reasonably, will attempt to contact the representative from each potential Award winners by email. Award winners must:
- Review, sign and return within the time frame specified by the Award Sponsor any and all agreements as required by the Award Sponsors, including waivers, release agreement, release of liability and indemnity agreements and intellectual property licences for use of company materials (example: name, logos, other design marks).
- Be available to be profiled in the ROB section of The Globe and Mail print newspaper and globeandmail.com in the Spring of 2019.
- Make reasonable efforts to attend any award ceremony, if one is held, in Toronto, Ontario in the Spring of 2019.
Award Sponsors may, at their sole discretion, profile one or more of the confirmed Winners and Finalists in print, video, digital, electronic, mobile and social media formats of the Award Sponsors. All confirmed Finalists hereby consent to the profiling and publication of Eligible Business in accordance with these Employer Terms and Conditions, and will use reasonable efforts to cooperate with the Award Sponsors in the preparation of such profiles and publicity by the Award Sponsors.
Potential finalists determined by the Award Sponsors to be ineligible, for reasons including but not limited to failure to comply with the Employer Terms and Conditions, will be disqualified from the Award. The Award Sponsors reserve the right to award the potential award winner spot to the Submission with the next highest score in accordance with the criteria in their sole discretion.
Warranties, Representations and Licences. All materials submitted become the property of the Award Sponsors and will not be returned to the Eligible Businesses. You hereby represent and warrant that the information you have provided in the registration and the Employer Questionnaire is true, complete and correct to the best of your knowledge.
Employee Recognition Award Status. Eligible Businesses must indicate the year in which they won any Award in any written materials indicating the recognition (note the badge indicates the year won).
Identity of Eligible Business. Upon request by the Award Sponsors, each entrant must provide the Award Sponsors with proof of their identity, qualification as an Eligible Business. Award Sponsors may disqualify any Submission where such proof is not provided upon request. In the event of a dispute over the identity of an online entrant, entry will be deemed submitted by the authorized holder of the e-mail account, as assigned by the internet access provider, online service provider, or other organization (e.g. business, educational institution, etc.) responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
Snapshot Report. Each Eligible Business will receive a personalized report of your organization’s commitment to the four key pillars of: work, life, mental and physical health, based on the responses of your employees to the Employee Survey. The snapshot report is the confidential information of the Eligible Business.
Proof of Receipt. The sole determinant of time for the purposes of receipt of a valid entry and Submission and Employee Survey responses will be the computer servers of the Award Sponsors’ designated contractor. Proof of transmission (screenshots or captures, etc.) does not constitute proof of receipt.
Conduct. By applying for an Award, you acknowledge that you have read and understood these Employer Terms and Conditions and agree to abide and be bound by them and all decisions of the Award Sponsors, which shall be final and binding, without right of appeal, in all matters relating to this Award. The Award Sponsors reserve the right, in their sole and absolute discretion, to disqualify any entrant that it finds to be: (a) violating Employer Terms and Conditions; (b) tampering or attempting to tamper with the entry process or the operation of the Award; (c) acting in an unsportsmanlike or disruptive manner; or (d) attempting to undermine the legitimate operation of the Award. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS AWARD OR TO UNDERMINE THE LEGITIMATE OPERATION OF THIS AWARD MAY BE A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS. SHOULD ANY SUCH ATTEMPT BE MADE, AWARD SPONSORS RESERVE THE RIGHT TO SEEK REMEDIES AND DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW, AND TO BAN OR DISQUALIFY AN ENTRANT FROM THIS AND FUTURE AWARDS
Confidentiality. "Confidential Information" means any financial, human resource information, business information, technical data, or know-how disclosed either directly or indirectly by one party, its affiliates or its representatives to the other party that is clearly marked or indicated to be confidential. Subject to the exceptions set out below, the Award Sponsors shall keep confidential the Eligible Business’s Confidential Information and shall not use any of the Eligible Business’s Confidential Information except for the purpose of administering the Award and creating a personalized health report for your Eligible Business.
Your Employer Questionnaire data will be aggregated into anonymous reports to: (a) assess the health of your workplace compared with the results of other organizations; and (b) for independent research, reporting and analytical purposes.
The Award Sponsors shall take reasonable measures to protect the confidentiality of the Confidential Information, and avoid any unauthorized disclosure or use of the Confidential Information. Such reasonable measures shall be no less than the Award Sponsors applies to its own confidential information. The Award Sponsors shall immediately notify the Eligible Business of any unauthorized disclosure or use of Confidential Information of which the Award Sponsors become aware. The foregoing obligations shall not apply to Confidential Information that: (i) is or becomes generally available to the public other than as a result of disclosure by the Award Sponsors in violation of this Agreement; (ii) was known to the Award Sponsors prior to its disclosure to the Award Sponsors by the Eligible Business; (iii) becomes available to The Globe and Mail’s editorial department from any source other than an employee of The Globe and Mail who received such Confidential Information pursuant to this Agreement; (iv) was independently acquired or developed by the Award Sponsors without reference to the Confidential Information and without violating any of its obligations hereunder; (v) the Eligible Business has approved in writing for release; or (vi) the Award Sponsors are required to disclose by any applicable law or regulation or competent judicial, governmental or other authority or in accordance with the requirements of any applicable stock exchange, provided that the Award Sponsors, to the extent practical, gives the Eligible Business prompt written notice of such requirement prior to such disclosure.
Release of Liability / Consent to Publicity. By applying for an Award, the Eligible Business is deemed to: (i) confirm compliance with these Employer Terms and Conditions; (ii) consent to the use of the Eligible Business’s business, senior management staff names, city, comments, photographs, video, sobriquet, and/or other likenesses and all other indicia of personality, for publicity, general news, entertainment, advertising and informational purposes by each Award Sponsor and its parent, affiliated subsidiary and related companies, as well as the appearance at events, meetings and conferences by senior management staff without any additional compensation and as required by the Award Sponsors if your organization is chosen to receive an Award, without further notice or compensation; and (iii) release each Award Sponsor, its affiliates (including, without limitation, any parent, sister and subsidiary companies), suppliers of materials or services related to the Award and other parties in any way involved in the development or administration of this Award (including advertising and promotional agencies, public relations agencies), and all of their respective employees, directors, officers, shareholders, agents, partners, licensees, successors and assigns (collectively the "Releasees") from and against any and all manner of action, causes of action, suits, debts, covenants, contracts, claims, liabilities, demand or damages (including legal fees and expenses), of any nature or kind, arising out of, or in connection with your participation or attempted participation in the Award and the awarding or use of a prize, including as set out below in the Limitation of Liability section.
Limitation of Liability. Releasees do not assume any responsibility and each entrant releases Releasees from any and all claims, actions, damages, loss, injury, costs, demands and liabilities of whatever nature or kind arising in connection with the Award including, without limitation, the administration of the Award the selection and confirmation of winners. Without limiting the generality of the forgoing, Releasees are not responsible for (i) the incorrect or inaccurate capture of entry information; (ii) late, lost, stolen, illegible, damaged, misdirected, mutilated, garbled or incomplete entries or entries that are altered or otherwise irregular, mechanically reproduced, submitted using robotic, automated, programmed, or through illicit means, included in a bulk-drop off, or contain false information, or do not conform with or satisfy any or all of the conditions of the Employer Terms and Conditions, as determined by each Award Sponsor, in its sole and absolute discretion; (iii) any failure of, errors, or problems with websites associated with the Award, including any website feature, howsoever caused, (iv) traffic congestion on the Internet and any postal delays, strikes or failures, (v) injury or damage to an entrant's or any other person's computer related to or resulting from participating in the Award; (vi) any website functionality lost due to not having cookies enabled; (vii) any errors, omissions, incorrect or inaccurate information in any Award-related materials howsoever caused; (viii) the security or privacy of information transmitted via computer networks or for breaches of privacy including but not limited due to interference by third party computer "hackers" or otherwise.
Award Sponsors, in their sole and absolute discretion, reserves the right to withdraw, modify or terminate the Award, amend the Award at any time, and reject any and all applications in accordance with the Award process, without individual notice, and for any reason. Award Sponsors will not incur any liability whatsoever by reason of such withdrawal, rejection, acceptance or modification.
All intellectual property, including but not limited to trade-marks, trade names, logos, designs, promotional materials, web pages, source codes, drawings, illustrations, slogans and representations are owned by each Award Sponsor and/or its affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.
This Award is void where prohibited by law and is subject to all applicable laws and regulations. To the extent permitted by law, any dispute arising from this Award will be determined according to the laws of the Province of Ontario, without reference to its conflict of law principles, and the entrants consent to the personal jurisdiction of the courts located in Toronto, Ontario and agree that such courts have exclusive jurisdiction over all such disputes.
